Do you need a Covenant for a Junior Accessory Dwelling Unit (JADU), Accessory Residential Structure (ARS), Conditions of Approval (COA), Lot Tie, etc.?

What is a Covenant and why do I need one?

When necessary to achieve the land use goals of the City, the City may require a property owner(s) to execute and record a Covenant. A property covenant informs property owners of any restrictions that may apply to a piece of property. Covenants exist to limit the misuse of property and maintain the value of land. Covenants are generally found in the property’s certificate of title or a separate document referenced by the certificate of title.

A covenant runs with the land, meaning the covenant will exist regardless the transference/sale of the land.

Step 1.  Gather your information

  • Property Address
  • Assessor Parcel Number (APN)
  • Property Owner Information
  • Applicant Information (if different from the owner)
    • Applicant will need to provide a property owner authorization letter. 
  • Copy of Grant Deed
  • * In addition to the above information and documents: 
    • Covenants Restricting Use of Accessory Residential Structure (ARS) must provide:
      • 8.5”x 11” copy of site plan, floor plan, elevations of the accessory structure. Site plan shall clearly identify the location of the accessory structure on the site. 
    • Covenants Restricting Use of Junior Accessory Dwelling Unit (JADU) must provide:
      • 8.5”x 11” copy of site plan, and Junior ADU floor plan. Site plan shall clearly identify the location of the Junior ADU on the site. 

    • Covenants for Lot Ties must provide:

      • Legal description of each parcel
      • 8.5”x 11” copy of the site plan
      • 8.5”x 11” lot tie exhibit
    • Other types of Covenants:

Step 2.Apply Online

Fill out the online Covenant and Agreement  Application.

Step 3.Submit Payment

After you submit your application, usually within 1-2 business days,  you will receive an email with a link to pay for your application.

Step 4.We'll Respond via Email

Once payment is received, the Current Planning Division, will review your application which will take 2-4 weeks to process. Once approved, the assigned Planner will reach out via email with further instructions. 

Step 5.Instructions For Filing Covenant and Agreement Forms

  1. Current Planning Division will prepare the covenant form for signature.
  2. Property owner(s) must print and sign their name(s) — signature(s) must be notarized.
  3. Submit the signed and notarized form to the Current Planning Division for approval and signature. Case Planner will notify once the form is approved and ready for recordation.
  4. Record the Covenant and Agreement form with the Los Angeles County Registrar-Recorder and obtain a CERTIFIED copy (2 (two) if you would like to keep one for your records).  The County Registrar-Recorder is located at the following locations:
  • 12400 Imperial Hwy.   Norwalk, CA  90650
  • 14340 Sylvan St. Van Nuys, CA  91401
  • 44509 16th St. W #103   Lancaster, CA 93534
  • 11701 S. La Cienega Blvd., 6th Flr.  Los Angeles, CA 90045

The original form is kept by the County Registrar-Recorder and will be returned to the Current Planning Division at a later date.

5. Return the certified copy of the recorded form to the Current Planning Division.

Step 2.Bring documents to Current Planning 

Submit your Covenant and Agreement application with property owner signature, site plan, grant deed, additional above mentioned documents and payment to the Planner on Duty.

The Planner will review your application, which will take 2-4 weeks to process. Once approved, you will be contacted by email/mail with further instructions.
