At the City Council meeting on August 14, 2023, members of the public submitted public comment stating that one of the firearms dealers in the City with a legal nonconforming location announced the retirement of the owners.  They requested the City Council agendize a discussion of an emergency moratorium. The City Council obtained consensus to agendize a discussion of an emergency moratorium on the transfer of nonconforming uses.

At its meeting on Monday, August 28, 2023, beginning at 7 PM, the City Council will discuss a potential urgency ordinance on the transfers of legal non-conforming uses. More detailed information is available in the staff report for the item, which is available for review online.

Background

At its meeting on Monday, December 12, 2022, the City Council adopted an Ordinance, which added a new Chapter 11.19 to the Culver City Municipal Code. Chapter 11.19 of the Culver City Municipal Code has new permitting and security requirements for retail establishments selling firearms and ammunition, including: 

  • Requires firearm and ammunition dealers to obtain a local permit to operate, which must be renewed annually;
  • Requires specific site security and safe storage requirements;
  • Requires liability insurance;
  • Require dealers to post additional notices, including notices specifically warning about the risks and dangers associated with firearms;
  • Prohibits unaccompanied minors from the premises;
  • Prohibits from the premises persons known to be prohibited from possessing or purchasing firearms;
  • Requires regular City inspections of dealer’s premises;
  • Establishes record keeping and access standards such as requiring maintenance of inventory records and purchase records, and the ability of the City to inspect such records;
  • Requires an annual permit fee based on cost recovery (including annual inspection, record keeping, etc.); and,
  • Specifies that permissible hours of operation are 9:00 AM to 10:00 PM daily.
